Bermuda Flag Labor Law: The Cruise Flag Where Onshore Law Stays Onshore

Walk the crew corridors of a Princess, Cunard or P&O Cruises ship and your flag state is probably Bermuda, port of registry Hamilton. One documented reason the cruise lines chose it: under Bermuda law the captain can perform a legally valid wedding at sea, and wedding packages sell. Your employment terms came along with the marketing decision. That is how flags work, and it is why Bermuda flag labor law belongs in your sign-on reading.

The law behind a Bermuda SEA

Bermuda is a British Overseas Territory register, Category 1 in the Red Ensign Group, run by the Bermuda Shipping and Maritime Authority. The statutory frame is the Merchant Shipping Act 2002 and, for your contract, the Merchant Shipping (Seafarer's Employment) Regulations 2013, which carry the MLC's rules on employment agreements, medical certificates and repatriation. The UK ratifies the conventions and extends them; Bermuda writes them into local law.

The line to understand is the shoreline. Bermuda's Employment Act 2000, the island's onshore protection statute, applies to people working wholly or mainly in Bermuda. Crew on an internationally trading Bermuda ship sit outside it. There is no imported unfair dismissal regime and no onshore wage floor riding on the flag. The MLC-based regulations, your SEA and your CBA are the whole stack. For cruise crew that CBA is usually an ITF-covered agreement negotiated with the operator, and its wage scale, sick pay and disability schedule are the numbers that will actually decide your year.

What the 2013 regulations put on paper

The employment regulations require your SEA to be in English, and everything attached to it as well: the terms and conditions, the disciplinary procedure, the complaints procedure. That reads like a formality until a wage scale arrives in a language you were never shown. If an agent in Manila or Mumbai hands you a translated version, ask for the English text too. The English one is the contract.

The same regulations require a fixed-term agreement to state the maximum length of any voyage you are expected to undertake, and that stated maximum cannot exceed six months. The shipowner may stretch it by up to one month when repatriation on the exact date is not practical. Voyage length and contract duration are two different lines in the document. Read both, and read the extension clause between them, because a vague extension clause is how seven months becomes nine.

Wages sit in a sister instrument, the Merchant Shipping (Seafarers' Wages) Regulations 2013, which cover payment of wages and the monthly account. You are owed a monthly statement showing what was paid, at what rate, and what was deducted. On a cruise ship with service charge pools and an onboard crew account, that monthly statement is your audit trail. Keep every one.

What Bermuda flag labor law means in the hotel department

Most crew under this flag never touch a mooring line. They are cabin stewards, assistant waiters, galley crew, bar teams, spa staff. MLC 2006 does not care about the difference: anyone working on board is a seafarer, hotel ranks included, and the SEA a cabin steward signs under the 2013 regulations is the same legal instrument the bosun signs.

The practical difference is the wage structure. Hotel pay on cruise ships commonly splits into a low guaranteed base plus a service charge or gratuity share. Under this flag, only what is written counts. If the recruiter quoted you a monthly figure, find the wage line in the SEA or the CBA scale that actually produces that figure. What the flag's record says

The ITF lists Bermuda as a flag of convenience. The Red Ensign Group reports Bermuda around tenth on a recent Paris MoU White List, solid inspection country. And one P&O Ferries detail belongs here: when 786 seafarers were dismissed by video in 2022, one of the ships was Bermuda-flagged, so its statutory redundancy notification went to Hamilton rather than London. How Bermuda handles MLC compliance

The compliance chain runs through London and Hamilton at once. The United Kingdom ratified MLC 2006 on 7 August 2013 and extended the convention to Bermuda as a Red Ensign Group Category 1 register. Bermuda then wrote the requirements into its own law through the 2013 regulations package under the Merchant Shipping Act 2002. So when port state control boards in Miami or Southampton, the certificates on display are Bermuda documents backed by the UK's ratification.

Under MLC 2006, ships of 500 GT and over trading internationally must carry a Maritime Labour Certificate and a Declaration of Maritime Labour Compliance, and a copy must be posted on board where crew can read it. Find it. It tells you which shipowner is legally responsible for you, which is not always the brand painted on the funnel.

If something breaks, the route is fixed by MLC Regulation 5.1.5. Every ship must run an on-board complaint procedure. You have the right to be accompanied, the complaint and its outcome must be recorded with a copy to you, and filing one may not be held against you. If the ship stalls, the shipowner gets it next, then the flag state and port state control. Before you sign: the Bermuda flag checklist

Seven checks, ten minutes, before the pen moves.

  • Find the CBA reference in your SEA and get the scale page for your exact position, hotel ranks included.
  • Check the medical certificate and repatriation clauses against the 2013 regulations. Repatriation at the shipowner's cost is the default, and exceptions must be stated.
  • Ask which fund, in which country, receives contributions for you. There is no Bermudian social insurance riding along with the flag.
  • Confirm the SEA and every attached procedure is in English, and keep a signed copy before you fly.
  • If your pay includes a service charge or gratuity share, find the exact wage line that produces the number the recruiter quoted.
  • Check the stated maximum voyage length and the extension clause next to your contract duration.

How the Bermuda flag rates in port state control

Port state control keeps score on every flag. The regional inspection regimes publish each year which registers get detained most, and the ITF keeps its own list of flags of convenience. This is where Bermuda stands on the current lists:

  • Paris MoU (Europe and Canada): white list, rank 18 of 69, performance list valid July 1, 2026 to July 6, 2027.
  • Tokyo MoU (Asia Pacific): high performance, inspections and detentions 2022 to 2024.
  • ITF: listed as a flag of convenience, 2025 list.
  • MLC 2006: party to the Convention.
